Yaroslav Suris sued Pornhub, which hosts millions of adult videos, claiming the site's lack of subtitles violates the rights of deaf and hearing impaired under the Americans with Disabilities Act (ADA).
Suris argued that the deaf and hearing impaired can't understand the audio portions of the videos on the site, thus denying them similar access to the content, according to TMZ.
Pornhub vice president Corey Price responded to the allegations.
"We understand that Yaroslav Suris is suing Pornhub for claiming we’ve denied the deaf and hearing-impaired access to our videos," he told the outlet. "While we do not generally comment on active lawsuits, we’d like to take this opportunity to point out that we do have a closed captions category."
Update: Pornhub was forced to settle.

The attorneys have figured out this is some "Low Hanging Fruit."

It’s sad because website owners are being targeted and sued for a law they didn't even know existed but ignorance of this law is no excuse. Frankly speaking, if your site(s) don’t line up with this law correctly and a law suit is filed, it's Game Over for you.
Even if you don't have the money these firms will take you to collection to collect on the debt any way they can. They WILL attach whatever they can identify, your vehicle, your home, your furniture, your business assets, your paycheck, even your life insurance policy.

In short, you need to be ADA compliant because authorities aren’t messing around. If you think it’s a game, rest assured it’s not. Everything is coming under scrutiny and all these law firms have to do is find your site. The "Inconvenienced" disabled person they have working with them pays no fees, the attorneys work on a contingency basis.

It's becoming a Very Big Issue.

No one is Safe. It doesn't matter what type of website you have, from a Church or a City to a Small Mom and Pop store, even a School.
The attorneys find a person with some sort of disability and they have that person go to a website the attorneys have identified ahead of time, and they even school the disabled person how to lodge a complaint.
Then the law firm jumps into action and files a suit on behalf of the poor "inconvenienced" person. It's a win/win for both the disabled person and the law firm. (Can you say "Ambulance Chasers?")
Defendants try to argue there was no damage but the law is clear. If anyone covered under the ADA law goes to a site that is not in compliance and makes a claim they were inconvenienced, game over. They don't even have to prove damages, they just file the claim and you are in court, paying hefty legal fees followed by a Settlement.

There are legitimate complaints filed without a law suit and the business is ordered to comply and given some time, but when the complaint is filed WITH a law suit it's game overThe Law is on their side and You Loose.

ROBLES v. DOMINO'S PIZZA, LLC.

When Domino's Pizza lost a suit they appealed on the grounds that the law was arbitrary and no clear guidelines we established. They won their appeal and the case then went to the Ninth Circuit Court where the appeal ruling was set aside. The court ruled that "Full and equal access is required; no additional guidance is necessary."  Domino's Settled.
